Terms of Service
Effective date: October 14, 2026
These terms are an agreement between you and Flozit LLC, a Tennessee limited liability company ("Flozit," "we," "us"). You accept them when you check the box agreeing to these terms at signup. Our Privacy Policy at flozit.com/privacy explains how we handle data.
1. What Flozit does
Flozit helps real estate agents follow up with their existing leads by email. You choose leads by adding the Flozit tag to them in your Follow Up Boss account. In these terms, to tag a lead means to add that tag. Your AI assistant emails those leads from your own Gmail account and may reply to their answers. When a lead seems ready to talk or asks for you, Flozit hands the lead back to you. It emails you a short summary called a handoff brief, and adds a note and a call task in Follow Up Boss. Your AI assistant may send the lead one last short reply, then stops emailing that lead.
Flozit contacts leads only by email. It does not call or text leads, set appointments or negotiate for you.
Flozit is made for the cold leads that would otherwise slip away. Tag only the leads you want contacted by your AI assistant. Which leads you tag is always your call.
2. Who can use Flozit
To use Flozit you must:
- Be at least 18 years old.
- Hold an active real estate license in good standing, as a broker or as an agent working under a broker.
- Tag a lead only if you are licensed in the state where the home or area they asked about is located.
- Use Flozit only for your own real estate business. Use the name on your license and your brokerage's name. Do not use Flozit for personal or household purposes.
- Be in the United States.
- Have the right to use the Gmail and Follow Up Boss accounts you connect.
If you sign up as an individual agent, these terms bind only you. Giving us your brokerage's name does not make your brokerage a party to these terms. If you sign up on behalf of a team, brokerage or company, you confirm you have the authority to accept these terms for it. These terms then bind both you and that business. The business is the customer and is responsible for what each person it adds does with Flozit. Each agent whose leads are emailed must hold their own license, connect their own Gmail account and accept these terms themselves. The person who signs up for a team or brokerage needs a license only if their own leads are emailed.
We may review an account before turning it on, and we may decline any account.
3. The beta
Flozit starts as a free beta. Your account is in the beta until a paid plan starts for it or the beta ends, whichever comes first. While your account is in the beta:
- It is free. We will not charge you unless you choose a paid plan and enter your payment details yourself. We never turn a free account into a paid one on our own.
- Features can change, pause or end. We may limit how many agents or leads take part.
- If we end the beta, we will email you at least 30 days before it ends. Your free access stops on the end date in that email. To keep using Flozit after that date, your account will need a paid plan. If it does not have one by then, your account ends on that date.
4. What you confirm when you sign up
You confirm each of the following, by checking the boxes on the agreement screen and by accepting these terms.
Human review. Flozit staff may read the emails between your AI assistant and your leads, and may approve, edit or reject an email before it is sent. We do this to check quality and fix problems, and we keep a record of each review. Most emails are sent without a person at Flozit reading them first. Do not count on us to catch a problem before an email goes out.
AI disclosure. Your AI assistant's emails are built to tell the lead that it is an AI assistant working for you. You cannot turn this off, and you will not tell a lead that your AI assistant is a person.
Your own leads. You will only tag a lead if all of these are true:
- The person asked you, your team or your brokerage about buying, selling or renting a home, or was referred to you and expects to hear from you, or has worked with you before.
- Their email address came from them. They gave it to you, to the person who referred them, or to a website or service that passed their request to you. Leads from Zillow, Realtor.com and similar lead services count, as long as the person asked to be contacted. Leads your team or brokerage assigned to you count on the same condition.
- They have not asked you, your team or your brokerage to stop contacting them, and have not unsubscribed from your email.
- As far as you know, they are not your current client and have not signed an exclusive agreement with another broker.
- You do not know or have reason to believe they live outside the United States. Flozit is built for US agents and US leads. This is only about where the person lives now. Do not judge it by a name, a language, citizenship or where someone is from.
You will not tag people from lists that were bought, rented, scraped or handed to you without the person asking to hear from an agent. Old leads need extra care. Do not tag a lead whose email has bounced, or whose address you believe is no longer theirs. If a lead says they are working with another agent, or you learn that they have signed with another broker or listed their home with one, you will remove the Flozit tag from that lead right away.
Your license, your brokerage and the law. If you work under a broker, your broker or your brokerage's written policy allows you to use Flozit. If you are the broker, you confirm this for your firm. If your broker asks to see your AI assistant's emails, you will share them. You will follow your brokerage's rules on outside tools, advertising, client data and record keeping. You have the right to contact the leads you tag and to share their information with Flozit. If a lead belongs to your brokerage or team, you have its permission.
You are responsible for following the laws and rules that apply to you, including email marketing law, real estate license and advertising rules, fair housing law and any rules about disclosing the use of AI. You will not pick or skip leads because of race, color, religion, sex, disability, familial status, national origin or any other trait protected by federal, state or local law. Your notes may record what a lead said they need in a home. You will not add notes that label a lead by a protected trait or tell your AI assistant to treat a lead differently because of one. Your AI assistant is built not to discuss schools or neighborhood safety, but no tool can guarantee it. Fair housing compliance stays with you.
Your Gmail account. The Gmail account you connect is yours to use for business. If your brokerage or team owns it, you have its permission. Emails are sent from that account on your behalf. Google sets its own rules and sending limits, and it counts Flozit's emails together with everything else you send from that account. Google can limit, block or suspend an account that breaks its rules or gets spam complaints. That risk is yours. Flozit limits how many new emails it sends for you each day to lower this risk, but it does not control Google's decisions and is not responsible for them.
5. You are the sender
Emails your AI assistant sends go from your Gmail account, on your behalf, to your leads. They promote your services, so under US email law you are the sender. Flozit writes and sends them for you. That means:
- Your name, your brokerage's name and your business mailing address are added to each email. Your name and brokerage name must match your license records. The address must be your current business address: a real street address, or a PO box or mailbox registered to you or your brokerage. Keep all three current. If you cannot change one in your account, email support@flozit.com.
- Real estate advertising rules differ by state. Some states require more in an email, such as your license number, license type, your broker's name or phone number, or a registered team name. You are responsible for knowing what your state and your brokerage require. Flozit's emails include only the details you enter in your account. If your state or your brokerage requires something that Flozit's emails do not include, do not use Flozit for those leads. Flozit does not check state advertising rules and does not confirm that your emails meet them.
- If you change brokerages, or your license lapses, goes inactive, or is suspended or revoked, pause Flozit first and tell us at support@flozit.com. Turn it on again only after your details are updated and you have the right to keep working each tagged lead.
- Your AI assistant's emails are built to tell the lead how to stop. When Flozit detects that a lead has asked to stop, it stops your AI assistant's emails to that lead for you and records it in Follow Up Boss. It may send one short reply to confirm, with no marketing in it. Detection is automated and can miss a request. If you see a stop request Flozit missed, remove the Flozit tag from that lead and tell us at support@flozit.com right away.
- A stop request covers all your marketing email, not only Flozit's. When Flozit detects one, it adds a tag to that lead in Follow Up Boss so you can see it. Check for that tag at least once a week. Within 10 business days of the request, you must stop your own marketing emails to that lead, including drip campaigns and newsletters. If a lead asks you to stop in any other way, such as by phone or text, remove the Flozit tag right away and mark the lead do not contact in Follow Up Boss. Do not tag the lead again. Do not sell, share or pass their email address to anyone else, except to honor the stop request or where the law requires it.
- Whenever Flozit is paused or disconnected, or your account has ended, by you or by us, replies come only to you. You must act on any stop request you receive. Keep the Gmail address your AI assistant sent from open and able to receive replies for at least 30 days after your AI assistant's last email, because a reply is how a lead asks to stop. If you are going to lose that address, for example because you are leaving your brokerage, pause Flozit as early as you can and tell us at support@flozit.com.
- Flozit is built to skip some tagged leads, such as leads in a closed, past client or active client stage, leads with a do-not-contact tag, and leads you are already emailing. These checks are automated and can miss a lead. They do not replace your own care in choosing which leads to tag.
- When Flozit hands a lead to you, the next step is yours. Replies from leads also arrive in your own Gmail inbox. Keep reading it, and do not rely on Flozit alone to catch a reply.
- You will keep your Follow Up Boss records reasonably accurate, since your AI assistant writes from what is in them.
- If we ask where a lead came from, tell us within 5 business days and show us what you have. Tell us right away if Google warns, limits or suspends your Gmail account, or if anyone complains about an email your AI assistant sent.
- We may skip or stop emailing any lead if we think an email could break a law, a platform rule or these terms.
6. Flozit is software, not a brokerage
Flozit LLC is not a real estate broker or agent and holds no real estate license. Flozit is not a law firm, and nothing we provide is legal advice. States set different rules on what an unlicensed assistant may say to the public. Many states also require you to give a lead an agency or brokerage relationship notice early in a conversation. Your AI assistant does not give those notices. Checking that your use of Flozit fits your state's rules is your job. So is giving any required notice on time. If your state requires that notice before or during the kind of email conversation your AI assistant has, send the notice to each lead yourself before you tag them, or do not use Flozit for leads in that state. Your AI assistant is a software tool you use. Your AI assistant and Flozit staff do not represent you or your leads in any transaction.
Every email your AI assistant sends is your communication and your advertising, sent under your license. You are responsible for it as if you wrote it yourself. Each email is sent from your Gmail account, where you can read it. You agree to check these emails regularly and tell us right away if something is wrong.
When Flozit staff review an email, they check quality and fix problems. Staff are told to keep any edit inside the limits section 7 sets for your AI assistant. A staff edit can still contain a mistake. Staff do not give real estate, legal or compliance advice. Flozit does not take a commission, a referral fee or a share of any sale.
7. What your AI assistant will and will not do
Your AI assistant is built to start and continue a simple conversation, then hand the lead to you. It is not a licensed agent and is not meant to give real estate, legal, tax or lending advice. It is designed not to quote prices, give opinions on value, discuss schools or neighborhood safety, or promise a time for you to call or meet. If a lead's message is about sending money or a payment request, it is built not to reply, and to alert you.
Flozit uses new technology that is still developing. AI can make mistakes. An email may misread a lead's message or contain an error. Review by Flozit staff is a quality check. It is not a guarantee, it is not legal or compliance review, and it does not catch everything. Check any facts in your AI assistant's emails and handoff briefs before you rely on them.
Your AI assistant is built not to reply to a message that suggests a threat or a risk of self-harm, and to send it to you and to Flozit support. This check is automated and can miss a message. Flozit is not an emergency service and does not watch messages around the clock. If you see a message like this, act on it yourself, and call 911 if someone may be in danger.
We do not promise any particular result, such as a number of replies, appointments or closings.
8. Your connected accounts
Flozit connects to your Gmail and Follow Up Boss accounts with the access you grant. You give us permission to access those accounts and act in them for you, as these terms and the Privacy Policy describe.
- You can remove Flozit's access at any time. See flozit.com/your-data.
- Your use of Gmail and Follow Up Boss is covered by their own terms. Flozit is not affiliated with, endorsed by or sponsored by Google, Follow Up Boss or Zillow.
- If Flozit loses access to an account, it stops sending and we try to tell you. It cannot work until access is restored.
- You will keep your Google, Follow Up Boss and Flozit accounts secure. You are responsible for everything done through your Flozit account and the accounts you connect, except actions Flozit takes that break these terms. Tell us right away if you think someone else has used them.
9. Your data and how we handle it
In these terms, your data means your account details and what Flozit gets from your Gmail and Follow Up Boss accounts, including information about your leads. Lead data is the part about your leads.
Who owns what. Between you and Flozit, your leads, your Follow Up Boss records and your emails are yours. We claim no ownership of them. Emails your AI assistant writes for you are yours to use. If your brokerage or team has rights in the leads or records, you confirm you have its permission to use them with Flozit.
Who we take instructions from. We take instructions about an account only from the person who holds it or the customer who pays for it, unless the law requires otherwise. If they are different, the one who pays decides about the plan and payment. Each agent decides about their own Gmail connection, and can pause Flozit or ask us to delete their own data at any time. One exception: if your broker asks us in writing to pause your account, we may pause it and will tell you. We do not decide who owns a lead. We do not give your data to your broker, team lead or brokerage unless you ask, the law requires it, or you joined a team account and agreed, when you joined, to what the team's account holder can see.
Our role. You decide which leads Flozit contacts. Under state privacy laws, you are in charge of your lead data and Flozit only works on it for you. Those laws call you the business or controller, and Flozit the service provider or processor. We handle lead data for you and only as this section says. These terms and your settings are your instructions.
Your permission. You allow Flozit to read, copy, store and send your data, to write notes, tags and tasks in Follow Up Boss, and to create one Flozit Support contact with our contact details and setup steps. You can delete that contact at any time. We may do this only to:
- Write and send emails to leads you chose.
- Review those emails as section 4 describes.
- Detect and answer replies.
- Avoid emailing a lead you are already in contact with.
- Honor requests to stop.
- Hand leads back to you.
- Alert you and Flozit support to replies and problems that need a person.
- Look into complaints and legal claims about those emails.
- Keep the service secure and working.
We also use your account details to run your account. That means reviewing and turning on your account, answering your support requests, sending you notices, keeping our business records and, on a paid plan, billing you.
What we will not do. We will not sell your data or share it for advertising. We will not use your data for anything other than the uses described under Your permission above, unless the law requires it. We will not combine your lead data with another customer's lead data, and we will not use one customer's lead data for another customer. We will not use your data to train AI models, for research or to build other products. We will not use your data to contact your leads for ourselves or for any other customer. If another agent tags the same person in their own account, Flozit treats that as a separate lead and uses only that agent's data. Inside one team or brokerage account, we may apply a stop request to every agent on that account. We will not use your name or results in our marketing unless you agree. We may count things like emails sent and replies received to run and bill the service. Those counts never include lead names, addresses or message text.
Providers and people. We use the outside companies named in our Privacy Policy to run Flozit, and you agree to that. These terms call them our providers. Each may use your data only to provide its service to us. Before we add or replace a provider that handles lead data, we will update the Privacy Policy and email you. If you object, you can cancel. If you are on a paid plan and cancel for this reason within 30 days of our email, your plan ends on the day you cancel, and we refund the rest of the period you paid for. We delete your lead data as this section describes. Everyone at Flozit who can see your data must keep it confidential.
Requests from leads. You are responsible for having the right to contact your leads and for answering their privacy requests. If a lead asks what Flozit holds about them, we will tell them, after we confirm the request comes from that lead's own email address. If a lead asks us to delete their information, we delete what Flozit holds as our Privacy Policy describes, and keep a scrambled record so they are not contacted again. If a lead writes to Flozit directly, we may apply their request to every Flozit account that holds their email address. Doing that does not break our promise to keep each customer's lead data separate. We will tell you about the request. We will help you answer requests that need information from us.
Your records. Flozit is not your system of record. We keep short snippets, summaries and a few technical records only for the periods our Privacy Policy sets out. Sent emails and replies stay in your Gmail, and notes stay in Follow Up Boss. Keeping the records your state and brokerage require is your job.
Checks. We follow the privacy laws that apply to us as your service provider, and we give lead data the protection those laws require. If you reasonably ask, up to once a year or after a security incident, we will answer your written questions to show that we follow this section. If we find that we can no longer follow it, we will tell you within 5 business days after we find out, and you can tell us to stop and delete all your data. If you are on a paid plan and do that within 30 days of our notice, we refund the rest of the period you paid for.
When your account ends. We disconnect your Gmail and Follow Up Boss access and delete your lead data within 30 days after your account ends. Section 14 says when an account ends. If you ask us to delete all your data, we treat that as a cancel request too. Your account then ends when we process the request, even if a paid period has time left, and the 30 days count from the day you asked. Asking us to remove one lead does not cancel your account. On a team account, an agent's request to delete all their data ends that agent's account on the day we process it. It does not cancel the team's plan. If an agent leaves a team, the agent or the team's account holder must tell us. That agent's account ends on the day we process that notice. We then disconnect that agent's Gmail and delete the lead data Flozit holds for that agent as this section describes. Copies of alerts and handoff briefs in Flozit's own mailbox are deleted on their normal schedule, within about 4 months. We keep basic account details for our business records and delete them if you ask, except records the law requires us to keep. We also keep the record of what you agreed to at signup, and when, in case there is a later dispute about these terms. We keep a scrambled record of email addresses that asked to stop, or that we think may have asked, so they are not contacted again through Flozit for you.
If Flozit changes hands. If Flozit is sold or merged, we will ask for your explicit consent before your Gmail data moves to the new owner. That includes your Gmail connection and anything we stored from your Gmail. If you do not give it, your Gmail data does not move. We end your account as section 14 describes and delete your lead data as this section describes.
10. Security
We encrypt account access tokens, limit who can reach our systems and use secure connections. No system is perfectly secure. If we learn that your data in Flozit's systems or at one of our providers was lost, sent to the wrong person or accessed without permission, we will email you without undue delay. We will tell you what we know about what happened, what data was involved and what we are doing about it.
11. Paid plans
You pay nothing unless you choose a paid plan. This section applies only if we offer paid plans and you choose one, or someone else chooses one for your account.
Price and plan. The price, billing period and any free trial are shown on the checkout page before you pay. Those details are part of these terms. If the checkout page and these terms differ on price, billing period or trial length, the checkout page controls.
Automatic renewal. Paid plans renew automatically. You authorize us and our payment company to charge your payment method at the start of each billing period until you cancel.
Free trials. If your plan starts with a free trial, the checkout page shows when it ends and what you will be charged. Your first charge happens when the trial ends, unless you cancel before then.
How to cancel. You can cancel at any time online in your account when that is offered, or by emailing support@flozit.com. Cancelling stops future charges. A cancel request by email counts from the time you send it, if it comes from the email on your account. If it comes from another address, it counts from the time we confirm it is you. If a charge goes through after that, we refund it. After you cancel, your plan stays active until the end of the period you already paid for, or until the end of your free trial. Your account ends on that last day, and your AI assistant keeps working until then unless you pause Flozit. The 30 days for deleting your lead data count from that last day. If you want your data deleted sooner, ask us to delete it. There are two exceptions. First, if you ask us to delete all your data, that also cancels your plan, and your account ends when we process the request, as section 9 says. Time left in that period is not refunded, unless section 9 says it is. On a team account, an agent's request to delete their own data ends only that agent's account. It does not cancel the team's plan. Second, if you cancel because of a provider change or a material change to these terms, section 9 or section 18 applies.
Refunds. Payments are not refundable, and we do not give credit for a partly used period, unless the law requires it or these terms say otherwise. If we end your paid plan and you did not break these terms, we refund the unused part of the period you paid for.
Price changes. We may change the price of your plan. We will email you the new price, the date it starts and how to cancel. The new price starts with the first billing period that begins at least 30 days after that email. If you do not want the new price, cancel before that billing period starts.
Failed payments. If a payment fails, we will email you and may try again. If it stays unpaid, we may pause your account until it is paid, and may later end it.
Taxes. Prices do not include sales tax or similar taxes unless we say so. We add them where the law requires.
Payment processing. Payments are handled by a payment company we choose, such as Stripe. Its terms and privacy policy apply to your payment.
Billing problems. If a charge looks wrong, email us within 60 days so we can fix it. This does not limit your rights with your bank or card company. If you dispute a charge with your bank, we may pause your account until it is settled. We will not pause it because you asked us about a charge.
If someone else pays. If a team lead or brokerage pays for your account, they control the plan and can cancel it. Your data is still handled as section 9 describes.
12. Ownership of Flozit
We own Flozit, including its software, prompts and design. Until your account ends, you may use Flozit for your own real estate business. You may not copy it, reverse engineer it or use it to build a competing service.
AI-written text may not be protected by copyright, and similar text may be written for other agents.
If you give us feedback, we may use it freely without owing you anything.
13. Acceptable use
You will not use Flozit to:
- Do anything other than follow up with leads about your own real estate services.
- Send spam, or unlawful, deceptive, harassing or discriminatory messages.
- Contact people who have asked not to be contacted, or tag a lead again to restart emails to someone who asked to stop.
- Hide or remove the AI disclosure, or put wording in your Follow Up Boss records or account details meant to make your AI assistant hide that it is an AI.
- Discriminate against any lead because of a trait protected by fair housing law.
- Tag a lead you know or have reason to believe lives outside the United States, or anyone you know is under 18.
- Collect Social Security numbers, bank or card numbers, or health details.
- Break the terms of Google, Follow Up Boss or any other service you connect, or the usage policy of our AI provider (anthropic.com/legal/aup).
- Try to access another person's account or data, or interfere with the service.
- Open another account, or connect another Gmail account, to get around a pause or a limit.
- Resell Flozit, or let anyone use your account who is not allowed under these terms.
14. Pausing and ending
You can pause Flozit, disconnect your accounts or cancel at any time. To cancel, email support@flozit.com from the email on your account, or cancel online in your account when that is offered. The steps for pausing, disconnecting and deleting your data are at flozit.com/your-data. When you ask us to pause, or use the switch on your account page, your AI assistant stops sending as soon as we process your request. If you pause or disconnect, that does not cancel a paid plan or stop charges. To stop charges, cancel as section 11 describes.
We may pause or end your account if you break these terms, if a payment is overdue, or if your use creates legal or deliverability risk for you, your leads or Flozit. Examples are spam complaints, many bounced emails, a warning or limit from Google, or a complaint from a lead, your brokerage or a regulator. We may pause your account right away, without notice, and keep it paused while we look into it. When Flozit pauses because it lost access to an account you connected, it emails you. For any other pause, you can ask us why at support@flozit.com. If we pause a paid account for more than 14 days in a row, we refund the paused time, or credit it to your next bill if you prefer. This does not apply if you broke these terms, if the pause was for an unpaid or disputed charge, or if Flozit lost access to an account you connected. You can still cancel while your account is paused.
If we end your account because you broke these terms or a payment stayed unpaid, we will email you the end date, which can be the same day. We may also stop offering Flozit, or end your account, for any other reason. In that case we will email you at least 14 days before, or at least 30 days before if you are on a paid plan, and if you paid for time after the end date, we refund that part. Declining an account before we turn it on needs no notice period. If you paid for it, we refund all of it.
We may report serious misuse to Google or Follow Up Boss when the law requires it or when it is needed to keep the service secure.
Your account ends on the earliest of these dates:
- The day we process a request to cancel a free account.
- The day we process a request to delete all your data.
- The day we process a notice that you have left a team.
- The last day of the paid period or free trial, after a paid plan is cancelled.
- The day your plan ends under section 9 or section 18.
- The day we tell you we declined your account.
- The day the beta ends under section 3, if your account has no paid plan by then.
- The end date in an email from us ending your account.
When we decline an account, we email you the end date. For the other endings above, the date comes from your plan, from these terms or from an email from us.
When your account ends, we handle your data as section 9 describes.
15. No warranty
Flozit is provided as is and as available. To the extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that Flozit will be uninterrupted or error free, that emails will be accurate or delivered, or that every reply or stop request will be detected. Information from Follow Up Boss, Google or other connected services is passed along as is. We do not promise it is accurate or complete.
16. Limit of liability
To the extent the law allows, Flozit and its owners, staff and contractors are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost commissions, lost leads, lost data, loss of goodwill, or limits on or suspension of your Gmail or Follow Up Boss account.
The total liability of Flozit and its owners, staff and contractors for all claims about Flozit, added together, is limited to the greater of 100 US dollars or the amount paid to us for your account in the 12 months before the event that caused the claim. For a team or brokerage account, this is one limit for the business and all of its agents together, based on the total paid to us for that team or brokerage account.
These limits apply to every kind of claim, including contract and negligence. They do not apply to our fraud, gross negligence, reckless conduct or intentional wrongdoing, or to anything else the law does not let us limit. Refunds we owe under sections 9, 11, 14 and 18 are separate from this limit.
17. Your responsibility to us
This section applies to the extent the law allows. If someone brings a claim, complaint or investigation against Flozit, its owners, its staff or its contractors because you broke these terms or the law, had no right to contact a lead you tagged, or gave us wrong information, or because they say you did, you will cover the reasonable costs and losses that we and they have because of it. That includes reasonable attorney fees, settlements and, where the law allows, fines and penalties.
This covers a claim from anyone. Examples are a lead, your brokerage, another broker or agent, a regulator, a REALTOR association, Google or Follow Up Boss. We will tell you about a claim promptly. We choose our lawyer and decide how to respond. We will ask for your input before we settle. You owe only a settlement amount that is reasonable, and we will not admit fault on your behalf without your consent.
This section does not apply to the extent the problem was caused by our own negligence, our breach of these terms or our violation of the law.
18. Changes to these terms
We may update these terms. If a change is material, we will email you at least 30 days before it takes effect. If a law, a court, Google or Follow Up Boss requires a change sooner, we will email you as early as we can. Other changes take effect when we post them at flozit.com/terms with a new effective date. A change applies only from the date it takes effect. It does not apply to a dispute that began before that date.
If you do not agree to a material change, cancel before it takes effect, or within 30 days of our email if that is later. If you are on a paid plan and cancel for this reason, your plan ends on the day you cancel, and we refund the rest of the period you paid for. If you have not cancelled by then and you keep using Flozit, you accept the updated terms.
If a change to these terms or to the Privacy Policy lets us use your Gmail data or your lead data in a new way, or adds a new kind of charge, we will ask you to agree first. Using Flozit does not count as agreeing to that kind of change. If you do not agree, the change does not apply to your account, and we may end your account as section 14 describes. Other changes to the Privacy Policy follow the Privacy Policy's own section on changes. A provider change follows section 9.

19. Governing law and disputes
Tennessee law governs these terms and any dispute about them or about Flozit, wherever you are located. This is true even if a conflict of laws rule would point to another state's law. Any lawsuit about these terms or Flozit, including one against our owners, staff or contractors, must be brought only in the state or federal courts located in Tennessee, and each of us accepts those courts. One exception: if someone else sues one of us in another court over emails your AI assistant sent for you, that one may bring the other into the same lawsuit. Either of us may instead use small claims court where you live, if the claim qualifies.
To the extent the law allows, each of us gives up the right to a jury trial.
To the extent the law allows, each of us will bring claims only for itself, and not as part of a class action.
20. General
- These terms, the Privacy Policy, what you agreed to at signup, and any checkout page for a paid plan are the whole agreement about Flozit. If they disagree, the checkout page controls on price, billing period and trial length. On how we handle your data, section 9 and the Privacy Policy apply together. If they differ, the one that protects your data more applies. We do not use Gmail data in any way the Privacy Policy does not describe. These terms control on everything else.
- If a court finds part of these terms unenforceable, the rest stays in effect.
- If we do not enforce a term right away, we can still enforce it later.
- You may not transfer your account without our written consent. We may transfer these terms to a company that takes over Flozit's business. We will email you first, and you can cancel. Section 9 covers your Gmail data in that case.
- You and Flozit are independent businesses. Flozit is not your employee, partner or broker.
- These terms give rights only to you, to a business that is the customer under section 2, and to Flozit. They give no rights to your leads or to anyone else, including a brokerage that is not the customer. One exception: our owners, staff and contractors may rely on sections 15, 16, 17 and 19, including in any claim brought against them personally about Flozit.
- We send notices, including billing notices, to the email on your account, and you agree to receive them by email. Keep it current. Send legal notices to support@flozit.com.
- We are not responsible for failures caused by things outside our reasonable control, such as outages at Google, Follow Up Boss or our providers.
- Sections 9, 11, 12, 15, 16, 17, 19 and 20 continue after your account ends. So do what you confirmed in section 4, your responsibility for your AI assistant's emails and your accounts in sections 6 to 8, any refund we owe you under sections 14 and 18, your duties about stop requests in section 5, and any other term that by its nature should continue.
